By using this website or purchasing from FergZ Garage, you agree to these Terms and Conditions. If you do not agree, do not use the website or place an order.

1. Business Overview

FergZ Garage provides automotive-related products, performance parts, custom fabrication, media content, and related services. Products and services may include, but are not limited to, BMW performance parts, turbo-related components, engine parts, custom exhaust work, fabrication, shop-built parts, sourced-to-order parts, and vehicle-related services.

Some products may be stocked, while others may be sourced, fabricated, assembled, or ordered after purchase.

2. Website Use

You agree to use this website only for lawful purposes. You may not use this website to:

Commit fraud or provide false information.
Interfere with the website’s operation or security.
Copy, steal, scrape, or misuse website content.
Attempt unauthorized access to accounts, payment systems, or private information.
Use FergZ Garage branding, photos, videos, product descriptions, or designs without permission.

We may refuse service, cancel orders, restrict access, or take legal action if we believe the website is being misused.

3. Product Information

We do our best to provide accurate product descriptions, pricing, images, fitment notes, lead times, and availability. However, product information may contain errors, delays, missing details, or supplier changes.

Product photos may be examples only. Actual parts may vary slightly based on supplier availability, manufacturing updates, material changes, fitment revisions, or custom order requirements.

FergZ Garage reserves the right to update, correct, modify, or discontinue any product, service, price, description, option, or availability at any time without prior notice.

4. Vehicle Fitment and Compatibility

The customer is responsible for confirming that any product, part, or service is correct for their vehicle, build, engine, chassis, ECU, turbo setup, fuel system, exhaust setup, intended use, and local laws.

Fitment guidance provided by FergZ Garage is based on available information, experience, supplier data, or customer-provided details. It is not a guarantee that a product will fit every setup without modification.

Many performance parts, universal parts, turbo components, fabrication parts, and custom parts may require trimming, welding, tuning, fabrication, professional installation, or additional supporting parts.

5. Performance, Racing, and Off-Road Use

Many FergZ Garage products are intended for performance, racing, track, show, fabrication, testing, or off-road use only unless specifically stated otherwise.

The customer is responsible for ensuring that any product or modification complies with federal, state, local, emissions, safety, inspection, insurance, and road-use laws in their area.

FergZ Garage does not guarantee that any performance part, custom part, turbo component, ECU-related product, exhaust component, or modified vehicle setup is legal for street use, emissions-compliant, inspection-compliant, or suitable for public road use.

Use of performance parts may increase the risk of vehicle damage, engine failure, drivetrain failure, accidents, injury, legal issues, warranty denial, or emissions noncompliance. The customer assumes all risk.

6. Orders and Payment

Orders must be paid in full at checkout unless FergZ Garage approves a deposit, invoice, payment arrangement, or custom agreement.

By placing an order, you confirm that:

You are authorized to use the selected payment method.
Your billing, shipping, and contact information is accurate.
You understand the product/service being ordered.
You understand any listed lead time, backorder status, custom-order status, or special-order status.

We reserve the right to cancel, refuse, or refund any order for reasons including suspected fraud, incorrect pricing, supplier issues, unavailable parts, incomplete customer information, or inability to fulfill the order.

7. Deposits, Custom Orders, and Special Orders

Deposits may be required for custom work, fabrication, sourced-to-order products, special-order parts, or large jobs.

Unless otherwise stated in writing, deposits are used to reserve labor time, begin planning, purchase materials, order parts, or secure supplier inventory.

Deposits may be non-refundable once work has started, parts have been ordered, materials have been purchased, supplier orders have been placed, or custom fabrication has begun.

Custom orders, special orders, fabricated parts, modified parts, electrical components, opened fuel-system components, installed parts, and made-to-order products may not be eligible for return or cancellation unless approved by FergZ Garage in writing.

8. Lead Times and Availability

Some FergZ Garage products are sourced, ordered, built, assembled, or fabricated after purchase. Lead times are estimates only and are not guaranteed unless specifically stated in writing.

Supplier delays, shipping delays, customs delays, manufacturer backorders, material shortages, fabrication workload, holidays, incorrect customer information, or product revisions may affect fulfillment time.

If an order is delayed beyond the originally stated estimate, we may contact the customer with updated options, which may include continuing the order, modifying the order, substituting an item, or canceling/refunding the unfulfilled portion when applicable.

9. Shipping

Shipping costs, carriers, delivery windows, and tracking availability may vary based on product size, weight, destination, and carrier service.

FergZ Garage is not responsible for delays caused by carriers, incorrect addresses, missed deliveries, weather, theft after delivery, customs delays, or circumstances outside our control.

Customers are responsible for providing a complete and accurate shipping address. If an order is returned due to an incorrect address, refused delivery, or failed delivery attempt, the customer may be responsible for additional shipping costs.

Risk of loss may transfer to the customer once the carrier confirms delivery, unless otherwise required by law.

10. Damaged, Missing, or Incorrect Items

Customers must inspect all packages and products immediately upon delivery.

If an item arrives damaged, missing, or incorrect, contact FergZ Garage within 3 business days of delivery with:

Order number.
Photos of the package.
Photos of the damaged or incorrect item.
Photos of the shipping label.
A clear description of the issue.

Do not install, modify, paint, weld, cut, use, or dispose of any item before contacting us. Installed, modified, or used items may not be eligible for replacement, claim support, or return.

11. Returns and Refunds

Return eligibility depends on the product type, condition, supplier policy, and order type.

To request a return, contact FergZ Garage before sending anything back. Unauthorized returns may be refused.

Returned items must generally be:

Unused.
Uninstalled.
Unmodified.
In original condition.
In original packaging when possible.
Returned with all included parts, hardware, and documentation.

The customer may be responsible for return shipping, insurance, packaging, payment-processing fees, restocking fees, or supplier fees unless the return is due to a confirmed FergZ Garage error.

The following items are generally not returnable unless approved in writing:

Custom-made parts.
Fabricated parts.
Special-order parts.
Sourced-to-order parts.
Installed parts.
Used parts.
Modified parts.
Electrical or ECU-related components.
Fuel-system components.
Opened gaskets, seals, bearings, or engine internals.
Clearance or final-sale items.
Items damaged by improper installation, tuning, use, storage, or handling.

Refunds, when approved, will generally be issued to the original payment method.

12. Cancellations

Orders may be canceled only if the order has not already been processed, sourced, shipped, fabricated, assembled, modified, or started.

Custom orders, special orders, sourced-to-order parts, and fabrication jobs may not be cancelable once work or ordering has begun.

FergZ Garage reserves the right to cancel an order if the product becomes unavailable, pricing was incorrect, supplier cost changes significantly, customer information is incomplete, payment fails, or fulfillment is no longer possible.

13. Installation and Professional Use

Automotive performance parts should be installed by a qualified professional.

The customer is responsible for proper installation, tuning, break-in, inspection, maintenance, and safe use.

FergZ Garage is not responsible for damage caused by:

Improper installation.
Incorrect torque specs.
Missing supporting modifications.
Poor tuning.
Incorrect fuel or oil.
Overboosting.
Detonation.
Heat damage.
Misuse.
Track abuse.
Wiring errors.
Lack of maintenance.
Customer modification.
Third-party labor.
Failure to inspect parts before installation.

14. Tuning, ECU, and Engine-Related Products

Any ECU, turbo, fuel, ignition, engine, exhaust, or drivetrain-related product may require professional tuning and supporting modifications.

FergZ Garage does not guarantee horsepower, torque, drivability, emissions compliance, reliability, fuel economy, or engine safety unless specifically agreed to in writing.

Engine failure, drivetrain failure, sensor issues, wiring issues, fuel-system issues, or tuning-related issues are risks associated with modified vehicles. The customer accepts these risks when purchasing or installing performance parts.

15. Custom Fabrication and Vehicle Services

For shop services, fabrication, exhaust work, diagnostics, installations, or vehicle-related labor, FergZ Garage may provide estimates, invoices, deposits, work orders, messages, or written approvals depending on the job.

Customer approval may be required before work begins or before work exceeds an approved amount. Approval may be provided in writing, electronically, by invoice payment, by deposit, by text/message, or by other documented communication.

Final pricing may vary if additional issues are discovered, customer-requested changes are made, parts are missing, vehicle condition is worse than expected, broken hardware is found, fabrication requirements change, or additional labor is required.

Vehicles left with FergZ Garage must be picked up after completion or cancellation within the timeframe provided. Storage fees may apply where allowed by law and after proper notice.

16. Customer-Supplied Parts

FergZ Garage may accept customer-supplied parts at its discretion.

Customer-supplied parts are not covered by any FergZ Garage parts warranty. FergZ Garage is not responsible for supplier defects, incorrect parts, missing hardware, poor fitment, used part failure, counterfeit parts, or delays caused by customer-supplied parts.

Additional labor may be charged if customer-supplied parts require modification, cleaning, repair, replacement, or extra time to install.

17. Warranties

Unless specifically stated in writing, FergZ Garage makes no guarantee that a product or service will meet a particular performance goal, horsepower goal, fitment expectation, street-use requirement, emissions requirement, or racing outcome.

Manufacturer warranties, if any, are provided by the manufacturer or supplier, not FergZ Garage.

FergZ Garage may help customers communicate with a supplier or manufacturer when reasonable, but we do not control third-party warranty decisions.

Custom fabrication, performance builds, racing parts, engine parts, turbo systems, exhaust parts, ECU-related products, and special-order parts may have limited or no warranty due to the nature of performance use.

18. Pricing, Taxes, and Fees

Prices are listed in U.S. dollars unless otherwise stated.

Prices may change at any time without notice.

Taxes, shipping, handling, processing fees, shop supplies, disposal fees, storage fees, or other charges may apply depending on the order, service, location, and applicable law.

Customers are responsible for any taxes, duties, customs charges, import fees, or local fees associated with their purchase.

19. Chargebacks and Payment Disputes

If you have an issue with an order, contact FergZ Garage first so we can attempt to resolve it.

Fraudulent chargebacks, false claims, or payment disputes may result in order cancellation, refusal of future service, collection efforts, recovery of fees, or legal action.

20. Intellectual Property

All website content, including logos, photos, videos, graphics, product descriptions, templates, designs, captions, website layout, branding, and written content, belongs to FergZ Garage or its content providers unless otherwise stated.

You may not copy, reproduce, sell, repost, edit, distribute, or use FergZ Garage content for commercial purposes without written permission.

Customers may share FergZ Garage content for personal, non-commercial purposes if proper credit is given and the content is not altered in a misleading way.

21. User Content, Reviews, and Media

If you tag FergZ Garage, submit photos/videos, send build photos, leave reviews, or share content with us, you give FergZ Garage permission to repost, display, edit, crop, share, or use that content for marketing, website, social media, and promotional purposes unless you clearly state otherwise in writing.

You confirm that you own or have permission to share any content you submit.

FergZ Garage may remove or refuse content that is false, offensive, misleading, abusive, illegal, or unrelated.

22. Third-Party Links and Suppliers

The website may contain links to third-party websites, products, suppliers, brands, payment processors, shipping carriers, or social media platforms.

26. Indemnification

You agree to defend, indemnify, and hold harmless FergZ Garage, its owners, employees, contractors, suppliers, partners, and affiliates from claims, damages, losses, liabilities, costs, or expenses arising from:

Your purchase or use of products.
Your vehicle modifications.
Your violation of these Terms.
Your violation of any law or regulation.
